Agreement to Terms

By accessing and using Bestie applications and services, including Bestie Tele Track, Bestie Employee Track, and Bestie Office (collectively, the "Services"), you agree to be bound by these Terms & Conditions ("Terms"). If you do not agree to these Terms, please do not use our Services.

Description of Services

Bestie provides AI-powered business productivity applications designed to enhance telecalling operations, employee tracking, and office communication. Our Services include:

• Bestie Tele Track: Telecalling and lead management system with auto-dialing, call recording, and performance analytics
• Bestie Employee Track: Real-time location tracking, activity monitoring, and productivity reporting for field teams
• Bestie Office: Internal communication system with short extensions, one-click calling, and office management features

User License

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to:

• Download, install, and use our mobile applications on authorized devices
• Access and use our web-based services through supported browsers
• Use the Services for legitimate business purposes within your organization
• Create user accounts and manage team access as an authorized administrator

User Obligations

Acceptable Use

You agree to use our Services responsibly and in compliance with all applicable laws. You must not:

• Use the Services for any illegal, harmful, or unauthorized purposes
• Attempt to gain unauthorized access to our systems or other users' data
• Interfere with or disrupt the operation of our Services
• Reverse engineer, decompile, or attempt to extract source code
• Use the Services to harass, abuse, or harm others
• Violate any applicable privacy laws or regulations

Account Security

You are responsible for:

• Maintaining the confidentiality of your account credentials
• All activities that occur under your account
• Notifying us immediately of any unauthorized access
• Ensuring your account information is accurate and up-to-date

Data Accuracy

You warrant that all information you provide is accurate, complete, and current. You agree to update your information as necessary to maintain its accuracy.

Recording and Location Consent

Call Recording

By using Bestie Tele Track, you acknowledge and agree that:

• Calls may be recorded for quality assurance and training purposes
• You are responsible for obtaining necessary consent from all call participants
• You must comply with all applicable laws regarding call recording in your jurisdiction
• Recorded calls are stored securely and accessed only by authorized personnel

Location Tracking

By using location-enabled features, you consent to:

• Collection and processing of your location data during work hours
• Sharing of location information with your organization's administrators
• Use of location data for productivity reporting and client visit verification
• Storage of location history as specified in our Privacy Policy

Screen and Audio Recording

Where applicable, you consent to screen and audio recording during work sessions, understanding that:

• Recording is used for productivity monitoring and quality assurance
• You can disable recording features subject to your organization's policies
• Recorded content is treated as confidential business information
• Access to recordings is limited to authorized personnel only

Intellectual Property

All intellectual property rights in the Services, including software, designs, trademarks, and content, belong to Bestie or our licensors. You may not:

• Copy, modify, or create derivative works of our software
• Use our trademarks or branding without written permission
• Remove or alter any proprietary notices or labels
• Claim ownership of any part of our Services

Data Ownership and Processing

You retain ownership of your business data processed through our Services. We act as a data processor and:

• Process your data only as necessary to provide our Services
• Implement appropriate security measures to protect your data
• Do not use your data for our own commercial purposes
• Provide data export capabilities upon request

Service Availability

While we strive to provide reliable service, we do not guarantee:

• Uninterrupted or error-free operation of our Services
• Compatibility with all devices or operating systems
• Availability during maintenance periods or system updates
• Recovery of data lost due to technical failures

Limitation of Liability

To the maximum extent permitted by law:

• Our total liability shall not exceed the amount paid by you for the Services in the 12 months preceding the claim
• We are not liable for indirect, incidental, special, or consequential damages
• We are not responsible for data loss, business interruption, or lost profits
• You use our Services at your own risk

Indemnification

You agree to indemnify and hold harmless Bestie, its officers, directors, employees, and agents from any claims, damages, or expenses arising from:

• Your use of our Services in violation of these Terms
• Your violation of any applicable laws or regulations
• Infringement of third-party rights through your use of our Services
• Any content or data you submit through our Services

Termination

Termination by You

You may terminate your account at any time by:

• Contacting our support team
• Following the account deletion process in the application
• Ceasing to use our Services

Termination by Us

We may terminate or suspend your access immediately if you:

• Violate these Terms or our policies
• Engage in fraudulent or illegal activities
• Fail to pay applicable fees
• Pose a security risk to our Services or other users

Effect of Termination

Upon termination:

• Your right to use our Services immediately ceases
• We may delete your account and associated data
• You remain liable for any outstanding obligations
• Provisions regarding liability and indemnification survive

Updates and Modifications

We reserve the right to:

• Update our Services with new features and improvements
• Modify these Terms with reasonable notice
• Change our pricing and service plans
• Discontinue features or Services with appropriate notice

Continued use of our Services after changes constitutes acceptance of the updated Terms.

Governing Law

These Terms are governed by the laws of India. Any disputes arising from these Terms or your use of our Services shall be subject to the exclusive jurisdiction of the courts in Hyderabad, Telangana.

Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions shall continue in full force and effect. The unenforceable provision shall be replaced with an enforceable provision that most closely reflects the original intent.

Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements, constitute the entire agreement between you and Bestie regarding the use of our Services.
